The Viarentals.com website (hereafter referred to as the "Site") is operated by Viarentals SARL (hereafter referred to as "us", "we") a company registered in Paris, France under number : RCS PARIS 521 490 888. It consists of a collection of online ressources for accomodation rental and various associated services (hereafter referred to as the "Service").

These Terms & Conditions  (hereafter referred to as the "Terms") govern your access to the Site and use of the Service. 

1. Acceptance of Terms

By accessing the Site and using the Service, you agree to be bound to the Terms and Privacy Policy which you acknowledge to have read and understood. We reserve the right, at our sole discretion, to modify these Terms at any time. It is your responsibility to review these Terms on a regular basis to keep yourself apprised of any changes. Continued use of the Service after any such changes shall constitute your consent to such changes.


2. Rental Platform

You understand and agree that the Site is a rental platform that enables You and other Users to conclude rental transactions and consequently that Viarentals is not a party to any rental transaction unless specifically mentioned on the Site. We do not own or manage, nor can we contract for, any rental property listed on the Site unless specificaly mentioned on the Site. 

Instead, the Site acts as a rental platform to allow homeowners and property managers ("Hosts") who create ad pages on our Site to offer for rent a specific property to potential renters ("Guests"). Potential rental transactions are only binding among the concerned Host and Guest, who are solely and entirely responsible for their performance. 

Consequently, any part of an actual or potential transaction between a Host and a Guest, including but not limited to quality, safety, ability to meet any requirements and legality of the advertised properties, truth and accuracy of ad pages and reviews, ability of Hosts to rent a particular property or ability of Guests to pay for a rental are the sole reponsiblity of each concerned User.

Hosts are solely responsible for the condition of their properties listed on our Site and the compliance with laws, rules or regulations that may be applicable to any rental property in any jurisdiction.


3. Unauthorized Uses of the Site

Unauthorized uses of the Site include, without limitation:

(i) Copy, reproduction, extraction, scraping, republication, display or otherwise distribution of any part of the content of the Site in any form (see exceptions at the end of this section)

(ii) Use of any automated or manual process to monitor, copy, retrieve or keep an electronic or physical copy of the content or any portion of the Site (see exceptions at the end of this section)

(iii) Translation into any language, or creation of other derivative works from any content of the Site without our prior written consent

(iv) Use of the Site's enquiry functionality for any other purpose than researching rentals and making legitimate enquiries to Hosts

(v) Publish or transmit information that might be considered fraudulent, false, or misleading, including making any enquiry under false pretenses, sending or publishing spam, phishing or any other type of material that may give rise to criminal or civil liability

(vi) Publish or transmit any threatening, abusive, defamatory, vulgar, pornographic or profane material

(vii) Use or access the Site in any way that could adversely affect the performance or function of the Site 

(viii) Any commercial use (other than by authorized Hosts) of the Site or any content of the Site, including but not limited to : Sell or offer for sale, transfer, or license any portion of the Site in any form to any third parties without our prior written consent

The license to use the Site granted in these Terms excludes any right of collection, aggregation, copying, scraping, data mining, display or derivative use of the Site by any manual or automated means. However, a limited exception from the foregoing exclusion is provided to general purpose internet search engines and non-commercial public archives that may use such tools to gather information for the sole purpose of displaying relevant hyperlinks to the Site, provided they each do so using an easily identifiable agent and comply with our robots.txt files. 

"General purpose internet search engines" excludes any website or service providing classified listings, rental advertisements or other property rental related businesses that may compete with Viarentals.

Users of the Site may print or download content of the Site to a local hard drive for their personal and non-commercial use only. Such content may be shared with individual third parties for their personal use, provided that the sharing User explicitly acknowledges the Site as the source of the material.

4. Copyright

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with these Terms.

All trade marks reproduced in this website which are not the property of, or licensed to Viarentals are acknowledged on the website.

This website may also include links to other websites. These links are provided for your convenience  and Viarentals does not , under any circumstances, endorse the related websites. You are free to create a link to this website from another website or document without Viarentals's prior written consent.

5. Identity Verification and Account security

Identity verification on the Internet cannot be guaranteed and we cannot and do not confirm each user's purported identity. 

You agree to (i) keep your login and password secure and confidential (ii) notify us immediately if you believe that your login information may have become known to an unauthorized person, and (iii) notify us immediately if you are contacted by anyone requesting your login and password (Viarentals representatives will never ask you for your password under any circumstances)

User acknowledges and agrees that neither the Site, nor any of its affiliates will have any liability to any User for any unauthorized transaction made using any User's login and password that occurs before such User has notified us of the possible unauthorized use of his login information and we have had a reasonable opportunity to act on that notice. 

We may also, without notice to you and at our sole discretion suspend or cancel your account at any time if we suspect that your account is being used in an unauthorized or fraudulent manner.


6. Limitations of Communications

You agree that, with respect to other users' personal information that you obtain through the Site or through any Site-related communication or transaction, we have granted to you a license to use such information only for Site and Service related communications excluding any other commercial use that the user hasn't expressly agreed to. Further, You may not disclose a User's personnal information to any third party without both our written consent and the written consent of the User. It is your responsibility to protect other user's personnal information and you assume all liability for the misuse or loss of such information.

Furthermore, You agree that other users may use your personal information to communicate with you in accordance with these Terms.
 

7. Responsibility for User-Contributed Content

Viarentals has no duty to and will not systematically pre-screen content posted on the Site by Hosts, Guests or other Users (including, without limitation, reviews, enquiries and property ad pages, collectively referred to hereafter as “user contributed content”) and is not responsible for user-contributed content. 

Hosts are solely responbible for the accuracy of their ad page, including but not limited to property description, pictures, availability, rental prices, location and amenities.

Guests are solely responsible for verifying the accuracy of such information and ensuring that they meet their requirements and expectations.

We reserve the right to decline to permit the posting on the Site of, or to remove from the Site any user-contributed content that may violate these Terms. We also reserve the right to disclose any information as permitted by prevailing law to satisfy any regulation or governement request if we determine that it would be in our best interest to do so.


8. Disclaimer of Warranties

This Site and Service are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim and you wave all warranties of any kind, whether express or implied, including without limitation : implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Viarentals does not warrant that (i) our Service or any products, services or information obtained through our Service will meet your requirements or expectations (ii) our service will be uninterrupted, timely, secure or error-free (iii) any information that your may obtain through our service will be accurate or reliable or (iv) any errors in any data or software will be corrected.

By using the Site or Service and concluding a rental transaction, your agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Users with regards to such interactions and transactions will be limited to a claim against that particular User or Users at the exclusion of Viarentals.

Consequently, you agree not to attempt to impose liability on, or seek any legal remedy from Viarentals, its officers, employees, representatives, agents and successors in right. Further, You shall indemnify and hold harmless viarentals and its officers, employees, representatives, agents and successors in right from any and all claims and damages of every kind and nature, arising of or connected with your interactions with other users or your experience as a Guest of Host in connection with performance of rental transactions concluded through our Service.


9. Termination

We may, at our sole discretion and with or without notice to you, with or without cause and at any time (i) terminate your access to the Site and our Service (ii) deactivate or delete any of your accounts and all related information and files as well as user-contributed content originating from you and (iv) bar you access to any of such files and Service.

Subscriptions are non refundable.


Hosts are not allowed to request Guests to mail cash, or utilize any instant-cash wire transfer service including, but not limited to Western Union or MoneyGram in payment for all or part of a property rental transaction.  Request or promotion of such unacceptable payment methods may result, at our sole discretion, in the immediate removal of the non-conforming ad pages from the Site without notice to the User and without refund.


10. Invalidity of the Terms

If any provision of these Terms is held by a court of competent jurisdiction to be void, invalid or unenforceable for any reason, such provision shall be enforced to the maximum extent possible so as to reflect the intent of the parties. The remaining provisions shall continue in full force and effect without being impaired or invalidated in any way.


11. Eligibility

Our services may only be used by members who can form legally binding contracts under applicable law. Users registering as a business entity, represent that they have the authority to bind the entity to these Terms. Each User represents and covenants that all information submitted to us and to the Site during such User’s registration with the Site shall be true and correct. Each User further agrees to promptly update their account information online as it changes and to promptly povide such proof of personal identification, ownership of property listed on the Site and authority to list said property as we may request.


12. Subscription Payment
Subscription payment must be made in EURO using any major credit card.


13. Applicable law

These Terms and all matters arising our of or relating to these terms shall be governed by the laws of  Paris, France, without regards to conflicts of laws and principles thereof.

Privacy Policy

This privacy policy sets out how Viarentals uses and protects any User information it might collect during the use of the Site.

Viarentals is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, you can be assured that it will only be used in accordance with this privacy statement.


We may collect the following information from Guests:

E-mail address, Full Name, Ip address (if any), Phone number (if any), Browsing information relevant to the Site and user-contributed content

We may collect the following information from Hosts and their additional contacts, if any are specified:

E-mail address, Full Name, Ip address (if any), Phone number (if any), Address, Browsing information relevant to the Site and user-contributed content

However, Viarentals does NOT collect or store any payment information. Credit Card payments are directly handled by Cybermut, the secured bank server from french Bank Credit Mutuel.
We require this information to understand your needs and provide you with a better service in various ways including, but not limited to:

Using the information to improve our products and services

Using the information to customize the Site according to your interests

If you chose to subscribe to our newsletter; Periodically sending you promotional emails about new products, special offers or other information which we think you may find relevant to your interests.
